M.Maruthupandi vs The Tamil Nadu Uniformed Services ...

Madras High Court|11 September, 2017

JUDGMENT / ORDER

By consent of both sides, this writ petition itself is taken up for final disposal.
2.The petitioner has come to this Court challenging the impugned order dated 02.08.2017 disqualifying the petitioner in the rope climbing event.
3.The learned counsel appearing for the petitioner assailing the impugned order, would submit that when the petitioner has participated in the written examination conducted by the respondents with Roll No.2501688, he was declared pass in the written examination and thereupon he was permitted to take part in the physical efficiency test at KVS Boys Higher Secondary School, Virudhunagar District. Even in the physical efficiency test, he was declared qualified. Finally, he was permitted to participate in the rope climbing test in the presence of the officials. The respondents had also videographed the rope climbing event. When the petitioner was successfully reaching the green line, the authorities, for the reason best known to them and to the dismay of the petitioner, asked him to climb down, as though the petitioner has committed a foul play. Accepting the instructions given by them, the petitioner came down. But the respondents have not informed on what ground and how the petitioner committed foul play, while participating in the rope climbing. Therefore, a direction should be given to the respondents to display the video clipping before this Court and once this Court peruses the same, everything would be cleared, it is pleaded.
4.But this Court had already issued several directions to redo the rope climbing and other tests long back and the respondents have also completed the said process and they have also issued the provisional selection list on 31.08.2017. Therefore, the petitioner's cannot claim anything now, after a lapse of one month. As the petitioner has come to this Court belatedly, this writ petition is dismissed. No costs. Consequently, connected miscellaneous petitions are closed.
