The prayer in this writ petition is for issuance of a Writ of Mandamus, directing the respondents 1 and 2 herein to provide a suitable alternative employment to the petitioner in the respondents corporation without affecting his scale of pay after referring the petitioner to the medical board and obtaining medical report in conformity with Section 47 of the Persons with Disabilities (Equal Opportunities Protection of Rights and Full Participation) Act 1995, within the time to be fixed by this Court.
2.Learned standing counsel appearing for the respondents corporation fairly submitted that the petitioner may be referred to the medical board and depending upon the report of the medical board, the case of the petitioner would be considered.
3.Recording the above submission made by the learned standing counsel for the respondents, the respondents 1 and 2 are directed to refer the petitioner to the Medical Board and subject to the report of the medical board, the respondents 1 and 2 shall consider the case of the petitioner for alternative employment under Section 47 of the Persons with Disabilities (Equal Opportunities Protection of Rights and Full Participation) Act 1995. Such exercise shall be completed within a period of one month from the date of receipt of a copy of this order.
With the above direction, this Writ Petition is disposed of. No costs. Consequently, WMP(MD)No.11346 of 2016 is closed.
