Petitioner is the holder of a mining permit. This is valid upto 08.12.2014. Petitioner is using mechanical devices for mining activity. On account of this, respondents 2 to 4 are interfering with the operation of mining activity.

I am of the view, if Ext.P2 permit is in force and petitioner has not violated any condition in Ext.P2 permit, using mechanical devices is not a ground to interfere with the rightful activity being carried out on the strength of permit. Accordingly, there is a direction to the respondents 2 to 4 not to interfere with the operation of mining based on a valid permit on account of deployment of mechanical devices.
The Writ Petition is disposed of as above.
