... RESPONDENTS These Writ Petitions are filed under Articles 226 & 227 of the Constitution of India praying to call for the records pertaining to the cases of the petitioners. Direct Respondents to consider the representations forwarded by the KMF to Respondent No.2 and its authorities as per Annexure-C Series. Hold that the petitioners are entitled to enjoy the pensionary benefits as per the Employees Pension scheme based on their pay exceeding the ceiling limit of Rs. 5000/-, …12 Rs. 6500/- or Rs. 15000/- as the case may be and to further holding that the action of the respondents in not permitting the petitioners to enjoy the pension scheme on the basis of their pay exceeding the ceiling limit is unconstitutional and is violative of the principles of proportionality. Direct respondent nos.1 to 5 to permit the petitioners to enjoy the pensionary benefits as per the EPF scheme by computing the pensionary contribution on the basis of the petitioners actual pay exceeding the ceiling limit from time to time and to and take and complete the necessary steps in this regard including a direction to the Respondent No.6 to deduct the said contribution from the salary of the petitioners and remit the same to the concerned PF authorities.
These Writ Petitions coming on for orders on this day the court made the following order.
ORDER The learned counsel for the petitioners is granted four weeks time for complying with the office objections, failing which, the petitions shall stand automatically dismissed without reference to the Court.
