Pursuant to the order dated 08.09.2010 of the Division Bench passed in Letters Patent Appeal No. 2130 of 2010, the present Misc. Civil Application preferred by original respondent No.2, was listed before this Court. During the course of hearing, a query was put to Mr. Vakil, learned Senior Counsel regarding raising the contentions in reply.
However, Mr. Vakil stated that as per the direction of the Division Bench, this Court may proceed with only the present application and the Court should restrain itself from adverting to the main petition.
The present application is filed in the main petition and without referring to the main petition, it will not be appropriate to decide the present application.
In view of the aforesaid request of the learned Senior Counsel not to refer to the main matter, it will not be appropriate for this Court to hear the matter. Hence not before this Court. Office shall list this matter before another Court after taking appropriate orders from Hon'ble Chief Justice.
