Heard learned counsel for the applicant and learned AGA for the State.
By means of this application, the applicant who is involved in case crime no. 168 of 2017, under Sections 376C, 506 IPC and Section 5/6 POCSO, P.S. Tindwari, District Banda, is seeking enlargement on bail during the trial.
Considering the fact that the prosecutrix is a minor girl aged about 8 years, her hymen was found torn at the relevant point of time and stitches were given by Suman Nursing Home. She is student of Class III. She in her statements recorded under Sections 161 & 164 Cr.P.C. has fully supported the prosecution case as spelt out in the FIR, the applicant is not entitled to be enlarged on bail at this stage. The prayer for bail is rejected and the bail application of the applicant is hereby rejected.
