THIS PETITION COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP, THIS DAY, THE COURT MADE THE FOLLOWING:
O R D E R The petitioner has sought for a direction to the respondent Nos.2 to 4 to incorporate the caste of the petitioner as Adi-Dravida (scheduled caste) in the school records and Transfer Certificate.
2. The petitioner submits that she belongs to Adi-Dravida caste which is recognized as scheduled caste as contemplated under the Constitution of India. It is submitted that the father of the petitioner Sri.Veera Pandian studied at Government D.C.M.Higher school. The transfer certificate issued by the Government D.C.M. Higher Primary School, Robertsonpet, K.G.F. relating to the petitioner’s father indicates the caste as Adi-Dravida (scheduled caste). The Tahsildar has issued the caste certificate of the petitioner showing the caste as Adi-Dravida (scheduled caste).
3. It is contended that at the time of admission made to the school, the column against caste was left blank, as such, the transfer certificate issued by the school St.Anne’s Higher Primary School does not disclose the caste. After she got admitted to St.Anne’s School in the year 2009, her father has made request with the school authorities to enter the caste of the petitioner as Adi–Dravida (scheduled caste). Despite submitting the caste certificate issued by the Tahsildar, the school Authorities have not responded to the request. Hence, the present writ petition.
4. Learned AGA would submit that no representation/request is made with the official respondents seeking for a direction as sought for. If any such representation is made, the same shall be considered in accordance with the Government Circular dated 17.02.2018 and appropriate action/decision shall be made.
In view of the aforesaid, this Court deems it appropriate to direct the petitioner to submit the representation with the respondent No.2 within a period of two weeks from today and if such representation is submitted, the same shall be considered by the respondent No.2 in accordance with law and appropriate decision/action shall be taken in an expedite manner, in any event, not later than four weeks from the date of submission of the representation.
With the aforesaid observations and directions, writ petition stands disposed of.
