Pola Roopitha and others … Appellants And Osmania University, Hyderabad Rep. by its Registrar and others … Respondents THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT APPEAL NO.1448 OF 2014 JUDGMENT: (per the Hon’ble The Chief Justice Sri Kalyan Jyoti Sengupta) This appeal is sought to be preferred against the judgment and order of the learned trial Judge dated 16th October, 2014 by which His Lordship has been pleased to dismiss the writ petition summarily.
The learned trial Judge has recorded the undisputed fact that as per the Regulations of the respondent University, if a student has more than 12 backlogs, he/she is not entitled to promotion to the next year. It was also not disputed by the learned counsel for the petitioners that each of his clients has more than 12 backlogs in I, II, and III years of B.E. course.
We find that the learned trial Judge has correctly applied the Regulations of the University, which are not under challenge before us or before His Lordship. It also appears that almost on identical fact this Court has also discouraged this sort of attempt by dismissing Writ Appeal No.1358 of 2014, by judgment dated 5th November, 2014.
The appeal is therefore dismissed.
Pending miscellaneous petitions, if any, shall also stand dismissed. There will be no order as to costs.
