In WRIT PETITION No.14213 of 2014 ORDER:
Heard the petitioner appeared in person and the learned counsel appearing for the respondents.
The petitioner has filed the present contempt case, wherein it has been averred that the respondents herein have flouted the orders dated 06.06.2014 passed by the learned single Judge of this Court in W.P.14213 of 2014, vide which, the respondent authorities were directed to consider the petitioner’s representation dated 04.04.2014 and pass appropriate orders thereon in accordance with the rules and regulations, if any, or the scheme governing the issue of compassionate appointment in the 3rd respondent entity.
The 3rd respondent filed counter affidavit stating that the orders passed by the learned single Judge of this Court have been complied with and passed orders in Rc.No.E2/SRRIT&CD/2014/158, dated 08.08.2014 rejecting the case of the petitioner stating that she is not eligible for appointment under compassionate grounds. The respondents stated that the petitioner is the sister of the deceased N.J.Srinivas Rao. The wife of the deceased N.J.Srinivas Rao furnished legal heir certificate and death certificate of her husband issued by the Greater Municipal Corporation and Family Members Certificate issued by the Tahsildar, Bandlaguda Mandal. As per the said certificates, there are five family members depending on the deceased N.J.Srinivas Rao, viz., wife, two sons and two daughters. As per the rules and regulations, the respondents paid retiral benefits of the deceased to his wife N.Sandhya Rani. The respondents have specifically stated in the counter that the petitioner is not entitled for compassionate appointment as the wife of the deceased is alive and is eligible for appointment on compassionate grounds in her husband’s place on production of financial status certificate from the concerned revenue authorities.
After hearing the both sides, I am of the considered opinion that the orders passed by the learned single Judge of this Court on 06.06.2014 in W.P.No.14213 of 2014 have been fully complied with by the respondents by considering the representation of the petitioner dated 04.04.2014 and passing of orders dated 08.08.2014.
In view of the above, no case for contempt has been made out against the respondents.
Accordingly, the Contempt Case is dismissed. However, the petitioner is at liberty to challenge the order dated 08.08.2014, if she is so advised.
