#. The petitioner has prayed for withdrawal of the amount of Rs.4,89,064/-. Initially, this Court allowed the petitioner to withdraw the said amount at the time of disposing of Special Civil Application No.4098 of 1999. However, subsequently on behalf of respondent No.2, MCA was filed being MCA No.724 of 2001 on the ground that the amount should not be allowed to be withdrawn by the present petitioner. This court while disposing of that MCA directed that the amount deposited in this court should not be allowed to be withdrawn by the present petitioner on the ground that some dues of respondent No.2 are required to be paid.
#. Now, by this MCA the petitioner has stated that the dues of respondent No.2 - Institution has already been paid and the certificate to that effect is also annexed with this MCA. Mr.Kariel, learned advocate appearing for respondent No.2 - P.D.Malviya Graduate Teachers College states that his client has already settled the dispute by accepting Rs.73542/- from the present petitioner towards the arrears of rent of the quarter and now the petitioner is not required to pay any amount to the institution respondent No.2 as their claim is settled.
#. In view of the aforesaid statement of Mr.Kariel who is appearing for respondent No.2, now there is no necessity to keep the aforesaid amount in this court. The petitioner is accordingly permitted to withdraw the said amount with accrued interest thereon if any. Registry is directed to pay the amount of Rs.4,89,064/- (Rupees Four Lakhs Eighty Nine Thousand Sixty Four Only) with accrued interest thereon if any to the petitioner after proper verification and identification in this behalf. The MCA is disposed of accordingly with no order as to costs.
