Counter-affidavit has been filed, which is taken on record.
The order dated 19.05.2011 has not been complied with. It has been stated in the counter-affidavit that the petitioner should submit all the receipts by which he had made the payment in the department as the records of the department are not tallying with the date of the payment which has been made by the petitioner.
The petitioner says that this is not the issue in question. Recovery citation has been issued by the Managing Director amounting Rs. 1,28,153.83 dated 17.02.2003, as contained in annexure-4 to the petition. In annexure-5, the same Managing Director has issued another recovery citation on 12.08.2004 amounting Rs. 1,12,539.07. It is clear that both the recovery citations have different amount. It is to be noted that vide anneuxre-6 the Tehsildar, Tehsil Nanpara, District Bahraich has recovered a sum of Rs. 1,35,300/-from the petitioner. The amount recovered from the petitioner is much more than any citation.
The Division Bench of this Court had directed the Managing Director to pass appropriate orders on the representation. The Managing Director instead of looking into the correct facts has sent the petitioner on red-herring. It has been directed that the petitioner had deposited all the receipts of his payment. This has been deliberately done to harass the petitioner and not to reach the proper conclusion. A cover up has been tried to be made by the Managing Director. The petitioner is running from pillar to post since 2003. The action of the opposite parties does not inspire any confidence. There is a deliberate and willful disobedience of the Court's order.

Let the Managing Director, U. P. Alpsankhyak Vittya Avam Vikas Nigam Ltd., Lucknow, appear in person before this Court on 21.11.2011 to show cause as to why proceedings for committing contempt of this Court should not be initiated against him and why he should not be punished under the Contempt of Court's Act.
