ORDER:
....Respondents This Writ Petition is filed complaining of over billing in respect of the petitioner’s Service Connection No.N16762 at H.No.22-6-974, Iranigalli, Hyderabad.
At the hearing, Sri Nazir Ahmed Khan, learned counsel for the petitioner, has not disputed that his client has a remedy of approaching the Consumer Grievance Rederessal Forum under Section 42(5) of the Electricity Act, 2003 and a further remedy of approaching Ombudsman under Section 42(6) thereof, if he feels aggrieved by the decision of the Consumer Grievance Redressal Forum.
Learned counsel for the petitioner submitted that on identical facts, this Court has allowed Writ Petition Nos.151 of 2012 and 33798 of 2011 by order, dated 03.07.2012.
Sri S.V.Ramana, learned counsel representing Sri O.Manoher Reddy, learned counsel for the respondents, has submitted that the facts in Writ Petition Nos.151 of 2012 and 33798 of 2011 are not similar to the facts in the present case.
Inasmuch as the petitioner has efficacious alternative remedies, he is relegated to the said remedies. The petitioner is permitted to rely upon the judgment, dated 03.07.2012, in Writ Petition Nos.151 of 2012 and 33798 of 2011. The Consumer Grievance Rederessal Forum shall consider whether the said judgment is applicable to the facts of the present case and take a decision thereon within a period of two months from the date of filing of application by the petitioner after hearing both sides.
Subject to the above directions, the Writ Petition is disposed of.
As a sequel to disposal of the Writ Petition, WPMP.No.36902 of 2014 is disposed of as infructuous.
