Heard learned counsel for the parties.
The petitioner is aggrieved by the order of interim stay dated 1.7.2014 granted by the second respondent/Sub- Divisional Magistrate and Sub-Collector, Vikarabad Division in Case No. C/2387/2008 pending appeal filed by the appellant therein. Curiously that appellant is not made a party to this writ petition. Therefore, I am not inclined to entertain this writ petition on the ground of non-joinder of necessary party. However, since the appeal is said to be pending with the second respondent as aforesaid, this writ petition is disposed of directing the second respondent to consider and dispose of the aforesaid appeal expeditiously. Miscellaneous applications, if any, shall stand closed. No costs.
