2. V.Kumaraguru . Respondent/Complainant .. Respondent/Defacto Complainant Criminal Original Petition has been filed under Section 482 Cr.P.C. to call for the records pertaining to the Cr.No.1020/2014 on the file of the 1st respondent and quash the same.
For Petitioner : Mr.D.Umashankar For Respondent-1 : Mr.C.Emalias, Addl. Public Prosecutor ORDER Petitioners are accused in Crime No.1020 of 2014 on the file of the 1st respondent and seeking to quash the same, the present revision has been filed.
2. A complaint has been lodged by the defacto complainant/ the second respondent herein on 23.10.2014 before the first respondent police against the petitioner and a case came to be registered for an offence under Sections 294(b), 341, 324, 506(ii) of IPC and to quash the FIR the petitioner has filed the present quash petition.
3. Today when the matter is taken up for hearing, Mr.V.Kumaraguru, defacto complainant/second respondent herein was present in Court and a joint Memo of Compromise had also been filed by both the parties to the effect that the second respondent is withdrawing the complaint given by him on his own volition. The said Memo of Compromise has been duly signed by both the parties concerned and it is also submitted that the First Information Report may be quashed.
4. Heard the learned counsel for the parties and perused the Joint Memo of Compromise filed by the parties.
5. Taking into consideration the fact that the parties have entered into a joint Memo of Compromise, no useful purpose would be served by proceeding with the case. The Joint Memo of Compromise shall form part of this order. Considering the submissions made and in order to meet the ends of justice, the proceedings in Crime No.1020 of 2014 is hereby quashed. The present criminal original petition is allowed. Consequently, connected miscellaneous petition is also closed.
