JUDGMENT / ORDER

1. This mater was heard on 15.05.2012, wherein, rule was issued and notice was made returnable today. In the meantime, ad-interim relief in terms of paragraph 14(F) was granted.
2. Learned advocate Mr. Dayani for the applicant files an affidavit narrating the incident which took place while serving the process of this Court to respondent nos.2 to 4. In light of the contents of the affidavit, wherein, he states that respondent nos.2 to 4 not only refused the notice issued by this Court but also behaved in unruled manner,for which, a separate complaint is already filed. The refusal is treated as good service. So far as respondent No.5 is concerned, the service could not be affected on account of aforesaid incident, which took place at Vadodara.
3. Therefore, registry is directed to issue fresh notice to respondent No.5 returnable on 19.06.2012, to be served through the Police Inspector of concerned police station where respondent No.5 is residing. Ad-interim relief to continue till then.
