1. Heard Mr. N.L.Ramani, learned Advocate for the petitioner, Ms. Moxa Thakkar, learned APP. for the respondent - State and Mr. Saheblal Bhudeprasad Singh respondent no.3 who is present in person.
2. The record shows that by order dated 12.10.2012 this Court (Coram : Hon ble Mr. Justice Rajesh H. Shukla) had issued fresh notice upon respondent no.5 returnable on 02.11.2012. However, the record shows that respondent no. 5 is not yet served. Mr. Ramani, learned Advocate for the petitioner states that as per instructions received by him, respondent no.5 has been transferred to Surat and therefore prays that fresh notice of Rule be issued upon respondent no.5.
