Minaxi vs Dr

High Court Of Gujarat|25 April, 2012

JUDGMENT / ORDER

The applicant - writ petitioner has taken out present application seeking below mentioned relief:-
"8b. Your Lordship may be pleased to grant amendment of the permit amendment of Special Civil Application No.3534 of 2012 in terms, as stated in the Schedule to the present application."
2. The applicant - writ petitioner has taken out present application on the ground that after the writ petition being Special Civil Application No.3534 of 2012 came to be filed, the respondent has issued termination order, which the applicant has now received and therefore, the writ petition is required to be amended.
3. In this context, it is noticed that the writ petition being Special Civil Application No.3534 of 2012 has been preferred on apprehension that the applicant - writ petitioner's service may be terminated. In the writ petition copy of the termination order is not placed on record. Now, when the services of the petitioner is terminated, the writ petition will have to be amended substantially and almost entire set of grounds will have to be appropriately amended.
4. Having regard to the aforesaid facts and circumstances, instead of allowing the applicant - writ petitioner to amend the petition, the application and the writ petition are disposed of by present order with clarification that it will be open to the applicant herein - writ petitioner to file fresh writ petition challenging the order of termination and the filing of present writ petition will not stand in her say.
With the aforesaid observations, clarifications and direction, present application and writ petition both stand disposed of.
