Heard learned counsel for the applicant and the learned AGA for the State and perused the record.
This application under Section 482 Cr.P.C. has been filed with the prayer to quash the charge-sheet as well as the entire proceedings of Case No. 245 of 2018, arising out of Case Crime No. 112 of 2016, under Sections 376, 294, 506, 354-A IPC and 3/4 Dowry Prohibition Act, Police Station George Town, District Allahabad pending in the Court of Juvenile Justice Board, Allahabad.
This is the fourth Application u/s 482 Cr.P.C. for the same cause of action. Earlier Applications u/s 482 Cr.P.C. were also filed with the prayer for quashment of the charge sheet, which were disposed of / dismissed. Therefore, this Application u/s 482 Cr.P.C. is not maintainable on the basis of same set of facts and for the same cause of action and is liable to be dismissed with cost.
The Application u/s 482 Cr.P.C. is malafide and amounts to misuse and abuse of process of the law and is dismissed with Rs.1000/- as cost.
The cost shall be deposited by the applicant in the Court of Magistrate concerned.
