The instant petition has been filed for a direction upon the respondent Nos.1, 2 & 3 to conduct investigation of Case Crime No.0157 of 2018 under Sections 366, 506 IPC and 3(2) (V) SC/ST Act. at Police Station- Lal Ganj, District- Mirzapur in a fair and transparent manner.
On earlier date, the Court had required the learned AGA to file an affidavit of the Investigating Officer with regard to status of the investigation.
An affidavit of compliance has been filed today by the investigating officer, disclosing that after investigation, a final report has been submitted. The reasons for submission of the final report are given in paragraphs No.6, 7, 8, 9 and 10 of the affidavit.
As final report has already been submitted, the petitioner would have remedy to file protest petition before the learned Magistrate.
In view of the above, the writ petition is disposed of by giving liberty to the petitioner to file protest petition against the final report in the concerned court below.
The bailable warrant issued against the investigating officer to secure his presence are discharged.
