1. Heard learned counsel for the petitioner as well as learned Standing Counsel for the State respondents.
2. Learned counsel for petitioner confines his relief for a suitable direction to respondent No. 4 to decide the recall application filed by the petitioner in Case No. 00656 of 2018 (Computer Case No. T201813540100656) (Gram Sabha Vs. Mishri Lal) under Section 67(2) U.P. Revenue Code - 2006 within the stipulated time.
3. Learned counsel for the petitioner submits that grievance of the petition would be sufficiently met in case respondent no. 4- Tehsildar (Judicial), Tehsil Moradabad, District - Moradabad considers and decides the aforesaid case in the time bound manner.
4. Learned Standing Counsel has no objection to the aforesaid prayer.
5. Considering the facts and circumstances of the case, without entering into the merits, respondent no. 4- Tehsildar (Judicial), Tehsil Moradabad, District - Moradabad is directed to decide recall application filed by the petitioner in Case No. 00656 of 2018 (Computer Case No. T201813540100656) (Gram Sabha Vs. Mishri Lal) under Section 67(2) U.P. Revenue Code - 2006 expeditiously, say within a period of two months from the date of production of certified copy of this order, in accordance with law, if there is no legal impediment.
6. It is further directed that the parties to the case shall cooperate in expeditious disposal of the case and shall not seek any unnecessary adjournment, neither any such adjournment shall be granted by the Court concerned, except in exceptional circumstances.
7. With above observations/directions, the writ petition stands disposed of.
