JUDGMENT / ORDER

Court No. - 84
Case :- WRIT - C No. - 5705 of 2009 Petitioner :- Mishri Lal Respondent :- State of U.P. and Another Counsel for Petitioner :- Indra Mani Tripathi Counsel for Respondent :- C.S.C.
Hon'ble Dr. Yogendra Kumar Srivastava,J.
Heard Sri Indra Mani Tripathi, learned counsel for the petitioner and Sri Indra Mani Kushwaha, learned Standing Counsel appearing for the State-respondents.
The case is listed under the head of "Cases in which lower court/trial court proceedings have been stayed."
Learned Standing Counsel points out that the present petition arises out of suit proceedings and a writ of certiorari is sought for quashing a judicial order.
In view of the law laid down in the case of Radhey Shyam vs. Chhabi Nath, (2015) 5 SCC 423, judicial orders of civil courts are not amenable to a writ of certiorari under Article 226.
The petition stands dismissed accordingly. Interim order, if any, stands vacated.
Order Date :- 25.10.2021 Nitendra (Dr. Y.K. Srivastava, J.)
