JUDGMENT / ORDER

Heard Sri Surendra Pratap Singh, learned counsel for the petitioner and Sri N.C.Mehrotra, learned counsel appearing for the respondents.
By means of this writ petition the petitioner has claimed that in view of Advertisement dated 27.10.2008 (annexure-1 to the writ petition) for selection to the post of Secretary Grade II in the Mandi Parishad, he is entitled to the relaxation as given under General Condition No.3.
According to the learned counsel for the petitioner, the said relaxation has not been granted to the petitioner and, therefore, his candidature has illegally been rejected on the ground of age limit.
Let counter affidavit be filed within three weeks. The petitioner shall have one week thereafter to file rejoinder affidavit.
List thereafter.
