(PER : HONOURABLE MR.JUSTICE AKIL KURESHI) Counsel for the petitioner submitted that after a gap of nearly two years, the appellate authority had fixed a date of hearing of the petitioner s appeal on 06.02.2012. The petitioner had, under letter dated 01.02.2012, requested for adjournment on the ground that relevant documents were lying in the factory premises, which premises were sealed under the order of the Labour Court. The appellate authority, however, proceeded to hear the appeal ex parte and dismissed the same by impugned order dated 15.03.2012. The petitioner, therefore, seeks an opportunity to present all relevant documents before the appellate authority and canvass legal submission on the basis of such documents.

We notice that along with the petition, petitioner has produced several documents which were not part of the record before the lower authorities. These documents have been produced to suggest that with the aid of such documents, the petitioner could establish the factum of having discharged substantially the export obligation under the import license.
We further notice that such documents are produced from page Nos. 47 to 2030. At this stage, we do not find it necessary that the petitioners should be burdened with taking out three sets of copies of nearly 2000 pages. The Registry, therefore, may issue notice to the respondent, as ordered above, which would contain the memo of the petition and Annexures A and B only. Counsel for the petitioner stated that the petitioner undertakes to supply such documents to the respondents, if and when necessary in the future.
