M.Gagan Bothra vs V.Giridharan

Madras High Court|29 June, 2017

JUDGMENT / ORDER

It is not in dispute that the order passed by this Court has been complied with in the form of return of documents to the petitioner on 07.09.2016 and however, the petitioner/party-in-person made a complaint that though this Court has passed the order, which is the subject matter of this Contempt Petition, as early as on 06.06.2016, the said order has been belatedly complied with and therefore, this Court directed the second respondent to file an affidavit explaining the reasons for delay and accordingly, an affidavit dated 05.06.2017 has been filed by the second respondent/contemnor and it is relevant to extract paragraph No.5 of the said affidavit:
5. With regard to the averments made in other paragraphs of the affidavit it is submitted that the original sale deed in question which was lying with the 1st respondent under Section 47-A (1) of the Indian Stamp Act, 1899 was returned to this respondent in his letter Doct.No.259 of 2015 dated 04.08.2016. This respondent by letter No.142/2016 dated 22.08.2016 informed the petitioner to get back the sale deed in question by producing the original fee receipt. The 2nd petitioner herein had got back the sale deed in question from this office on 07.09.2016. Since the order of this Hon'ble Court is duly complied with, the Contempt Petition filed by the petitioners may be closed. This Court is satisfied with the reasons stated in paragraph No.5 of the affidavit filed by the second respondent dated 05.06.2017.
2. Hence, this Contempt Petition is closed. However, it is made clear that as and when Court orders are received, the second respondent is directed to comply with the same scrupulously without any delay.
