JUDGMENT / ORDER

This Transfer Civil Miscellaneous Petition has been filed seeking to transfer H.M.O.P.No.239 of 2016 filed by the respondent/husband seeking divorce on the file of the Subordinate Court, Karur and transfer the same to Subordinate Court, Theni.
2. Though the respondent has been served and his name has been printed in the cause list, no one appeared for the respondent/husband and hence, this Court passes this order on merits.
3. The petitioner/wife and the respondent/husband got married on 18.01.2013. After sometime, a dispute arose between the parties and they have been living separately. The respondent/husband filed H.M.O.P.No.239 of 2016 before the Subordinate Court, Karur, seeking divorce. Whereas the petitioner/wife is residing along with her parents at Kottur, Theni District and it is very difficult for her to travel to Karur to attend the hearing of the case.
4. It is a trite law that the convenience of the wife should be given primary consideration while transferring the proceedings.
5. In view of that, H.M.O.P.No.239 of 2016 filed by the respondent/husband seeking divorce on the file of the Subordinate Court, Karur, is withdrawn and transferred to the file of the Subordinate Court, Theni.
6. Accordingly, this Transfer Civil Miscellaneous Petition is ordered as above. No costs. Consequently, the connected civil miscellaneous petition is closed.
