The present writ petition has been filed praying for a writ of mandamus commanding the Assistant Collector, Lalganj, District-Azamgarh to remove the encroachment allegedly made by certain villagers over Plot No. 117, which is recorded as Chak Marg in the revenue records.
The Standing Counsel has received instructions and has handed over a copy of the same to the Court, which is taken on record.
On the basis of his instructions, the Standing Counsel states that Plot No. 117 was inspected by the Lekhpal, who has submitted a report indicating that there is encroachment over Plot No. 117.
It would be appropriate that the facts stated in the instructions are brought on record through an affidavit by some responsible officer of the Revenue Department in the District.
The Standing Counsel prays for and is granted eight weeks' time to file his counter affidavit.
Issue notice to respondent No. 6 through registered post with acknowledgement due for which steps shall be taken by counsel for the petitioners within 10 days from today.
If, steps are taken, office shall proceed to issue notice fixing any date after eight weeks by which date, the respondent No. 6 may also file his counter affidavit. The petitioner shall have four weeks thereafter to file his rejoinder affidavit.
List after expiry of the aforesaid period before the Registrar who shall fix any date for Admission after counter affidavit and rejoinder affidavit have been filed by the parties. The Registrar may, if necessary, grant further opportunities to the parties to file their affidavits but not more than two further opportunities shall be granted by the Registrar.
