Heard learned counsel for the petitioners and Shri Tariq Maqbool Khan for the Gaon Sabha as also counsel appearing for the respondent no. 5.
The writ petition arises out of proceedings under Section 128 of the Revenue Code, 2006 and is directed against the order dated 09.04.2019.
Sub-section 4 of Section 128 of the U.P. Revenue Code, 2006 reads as follows:-
"Every order made by the Collector under this Section shall, subject to the provisions of Section 210, be final."
It is therefore, clear that the petitioner has a statutory alternative remedy under Section 210 of the U.P. Revenue Code, 2006, which has not been availed.
Under the circumstances, this writ petition is dismissed on the ground of availability of a statutory alternative remedy.
