1. Heard learned counsel for the parties.
2. Petitioner claims to be a dailywage employee working with the office of the second respondent, Executive Engineer, Construction Division-1, Public Work Department, Kanpur Dehat, since 1988. Thereafter, the petitioner came to be terminated by an oral order in 1994. The claim petition of the petitioner before the labour court was allowed and finally petitioner came to be reinstated on the post of Chaukidar on 29 March 2004. By the instant writ petition, petitioner primarily seeks the following relief:
"Issue a writ, order or direction in the nature of mandamus commanding the respondent no. 2 to consider the petitioner's regularization on the post of Chaukidar."
3. Learned Standing Counsel submits that the second respondent shall consider and decide the claim for regularization of the petitioner expeditiously.
4. In regard thereto, without entering into the merit of the case, as well as, rival contentions raised by the respective parties, it is provided that the second respondent, Executive Engineer, Construction Division-1, Public Work Department, Kanpur Dehat shall consider and decide the claim/representation of the petitioner, by a reasoned and speaking order, expeditiously, preferably, within eight weeks from the date of filing of certified copy of this order along with the copy of the writ petition.
5. With the aforementioned observations/directions, the writ petition stands disposed of.
