The petitioner has challenged the order dated 26th of April, 2010, passed by the Assistant Collector First Class, Tehsildar Sadar, Lucknow as also the order dated 29th of May, 2010, passed by the Additional Collector (Finance and Revenue), Lucknow, on the ground that Gata No.641 and Gata No.1063, situate at village Sirgamau, Pargana, Tehsil and district Lucknow is a vacant land and the petitioner has not encroached upon the same. The concerned Circle Lekhpal has also reported that the land is vacant, even then the order impugned for eviction of the petitioner has been passed, whereby under the garb of the order the recovery of Rs.30,000/- has been issued.
Considering the facts and circumstances of the case, I hereby stay the operation of the orders impugned dated 26th of April, 2010, passed by the Assistant Collector First Class, Tehsildar Sadar, Lucknow as also the order dated 29th of May, 2010, passed by the Additional Collector (Finance and Revenue), Lucknow till further orders of this court.
Four weeks time is allowed to file the counter affidavit.
