Heard learned counsel for the petitioner and learned Standing Counsel for respondent.
The petitioner has preferred the present writ petition with the following prayer:-
"Issue a writ, order or direction in the nature of mandamus directing the Court below to decide the application under Section 42-A being Reference No.73 under Section 48(3) of U.P.C.H. Act in respect of correcting the map of Plot No.285, 286, 288, 289 293, 296 situated at Village Audhe Pargana Dehat Amanat, District Varanasi."
It is contended by learned counsel for the petitioner that application under Section 42-A being Reference No.73 under Section 48(3) of U.P.C.H. Act filed by the petitioner is pending consideration before respondent/Deputy Director of Consolidation, Varanasi since 23.02.2016. It is argued that considerable time has already been lapsed but till date no decision has been taken and prays for expeditious disposal of the same.
Heard learned counsel for the parties present. With the consent of learned counsel for the parties present, the present writ petition is disposed of at the admission stage itself.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the respondent/Deputy Director of Consolidation, Varanasi to consider and decide the aforesaid application in accordance with law expeditiously and preferably within a period of four months from the date of production of certified copy of this order but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, except upon payment of cost.
