Heard Sri Ranjay Kumar, learned counsel holding brief of Sri Achyut Jee, learned counsel for the applicants.
This application has been filed under Section 482 Cr.P.C. with the request to quash the entire proceedings of complaint case no. 67 of 2017 (Smt. Somari Devi vs. Mevati and others), under Section 419 and 420 IPC, P.S, Kotwali, District Ballia pending in the court of C.J.M. Ballia and stay the operation of order dated 25.10.2017 by which applicants have been summoned.
Learned A.G.A has vehemently opposed the request for quashing the summoning order and submitted that remedy of filing revision is available against summoning order.
Considered the submission of learned counsel for the parties. Keeping in view that effective remedy is available by filing a revision, I do not find any valid reason for interference in the impugned order, therefore the application is disposed of with the direction that if the applicants surrender and apply for bail within one month from the date of receipt of this order before the Court below, their bail application will be considered and decided expeditiously, if possible, on the same day.
With the aforesaid direction the application is disposed of.
