1. Amendment application is allowed.
2. Amendments are treated to have been incorporated.
3. By the aforesaid amendment, the petitioner seeks quashing of the order dated 07.11.2017 passed by the Assistant Provident Fund Commissioner under Section 14(B) of the Employees Provident Fund & Miscellaneous Provision Act, 1952.
4. At the outset, Sri Amit Kumar Singh, learned counsel for the respondent nos. 2 to 5 has raised a preliminary objection that the order impugned is appellable under Section 7(I) of the aforesaid Act. The objection is well founded.
5. The writ petition is disposed of with the observation that in case the petitioner files a proper appeal before the Tribunal within three weeks from today along with the certified copy of this order, the same may be heard and decided on merits without raising any objection as to limitation.
