JUDGMENT / ORDER

THE HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.29050 of 2014 Dated : 25.09.2014 Between:
Merugu Rayamallu S/o. Mallaiah, Age : 57 yrs, Occu : Pump Operator, R/o.Qtr.No.8-2-33, Vinobha Nagar, Godavarikhani town Ramagundam Mandal, Karimnagar District.
.. Petitioner And Union of India, rep., by Ministry of Communications, New Delhi & 3 others .. Respondents This Court made the following :
THE HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.29050 of 2014 ORDER :
The petitioner claims to be working as pump operator with Singareni Collories Company Limited, Godavarikhani-8 Incline, Godavarikhani. The petitioner has saved some money from out of the earnings and invested them in Kisan Vikas Patras. The said Kisan Vikas Patras matured on 31.09.2010 and the petitioner is entitled to receive the proceeds of such investment. On maturity, when the petitioner approached the authorities for redeeming the bonds, by a letter dated 16.09.2014 the Superintendent of Post Office, informed the petitioner that he should produce the originals of Kisan Vikas Patras and should surrender them and on production of originals and surrendering them, the amount due and payable to him would be paid. Aggrieved thereby this writ petition is filed.
2. The competent authority was insisting for production of original Kisan Vikas Patras. Petitioner’s contention that the originals are lost and the police complaint is filed and since he does not have the originals of Kisan Vikas patras, the amount should be released was not acceded to since his wife informed the respondents that the originals of Kisan Vikas Patras are with her. This statement is not seriously disputed. This would show that as rightly stated in the letter dated 16.09.2014, the originals are available and they have to be produced.
3. The decision of respondent authority directing petitioner to surrender the original certificates of Kisan Vikas Patras to claim the proceeds of said patras cannot be faulted. More so, when originals are available. Hence, I see no error in the decision communicated to the petitioner calling upon him to produce the originals. The competent authority cannot be dragged into the internal dispute between the petitioner and his wife. There is no merit in the writ petition.
4. Accordingly, the writ petition is dismissed. However, the dismissal of this writ petition does not bar the petitioner to produce original Kisan Vikas Patras and as and when such originals are produced, the respondents shall act upon the same in accordance with the terms of the Kisan Vikas Patras. There shall be no order as to costs.
5. Miscellaneous petitions, if any, pending in this writ petition, shall stand dismissed.
