JUDGMENT / ORDER

The petitioners in the writ petition are students who got admission during the academic year 2007-08 in the merit quota for BDS course in the 3rd respondent College. The admission process was completed after following the allotment process conducted by the Entrance Commissioner. The dispute in the writ petition revolved around the fees to be paid in respect of the course. While the fee fixed by the Fee Regulatory Committee was an amount of Rs.87,000/- per annum, it appears that pursuant to an agreement between the management and the Government, the fee receivable in respect of students under the merit quota was reduced to Rs.20,000/-, as annual tuition fee, and interest free refundable deposit of Rs.1,75,000/-. There was an enhancement of the fee that could be collected from the students who applied for the management quota but that is not relevant for the purposes of the present writ petition.
2. All the petitioners except petitioner No.8 have completed the BDS course and the 8th petitioner is presently undergoing House Surgency. It is stated by counsel for the petitioners as well as the respondents that they have decided to amicably resolve the issue with the management offering to accept a total fee of W.P.(C).No.11524 of 2010 2 Rs.2,75,000/- from the all the petitioners, except petitioners 11 and 12, who, it is submitted, do not have any subsisting grievance in the matter.
In the facts and circumstances of the case, this writ petition is disposed by recording the settlement arrived at between the parties whereby the management will now accept, as fee payable by the petitioners except petitioners 11 and 12, an additional amount of Rs.14,000/-each in full and final settlement of their liability towards fees to the 3rd respondent. Needless to say on such payment being made by all the petitioners, except petitioners 11 and 12, all the certificates collected from the aforesaid petitioners at the time of admission shall be returned to them along with the course completion certificate.
