ORDER:
This Contempt Case is filed alleging willful disobedience of order, dated 14.08.2013 passed by this Court in Writ Petition No.23924 of 2013.
The Contemnor is present.
Learned Government Pleader for Revenue (Andhra Area) conceded that before passing the order adverse to the petitioner’s interest, no notice has been issued to the petitioner. As this action is in the teeth of the order of this Court, the learned Government Pleader has stated that the respondent will withdraw the said order and pass a fresh order after issuing notice to both the parties and holding an enquiry.
In the light of the above submissions, the Contempt Case is closed with liberty to the petitioner to file a fresh contempt case in the event the respondent does not comply with the undertaking given by him through the learned Government Pleader as noted above.
