JUDGMENT / ORDER

The petitioner intends to construct a residential building in the property owned by her. The petitioner wants to extract ordinary earth from the site covered by the proposed residential building. In view of the Government Order produced as Exhibit P2, it is not necessary to obtain permission from Geologist for extracting ordinary earth from the site covered by the building permit. However, for the purpose of transporting the ordinary earth the petitioner requires ‘P Form’. 2. This land is situated in Grama Panchayath wherein the building permit is not required for constructing a residential building. The local authority has issued No Objection Certificate
3. In view of the above, there shall be a direction to the 3rd respondent to issue necessary ‘P-Form’ to the petitioner for transporting ordinary earth from the site covered by the proposed residential building, on being satisfied with the genuineness of the claim raised by the petitioner. Needful W.P.(C).No. 26817 of 2014 2 shall be done within a period of ten days from the date of receipt of a copy of this judgment.
The writ petition is disposed as above.
