This application has been filed seeking quashing of the order dated 16.4.2019 and the order dated 16.1.2018 passed by the Principal Judge, Family Court, Azamgarh in Execution Case No. 110 of 2018, Rokaiya versus Meraj, under Section 128 Cr.P.C. and Case No. 621 of 2016, under Section 125 Cr.P.C., P.S. Saraimeer, District Azamgarh.
Heard learned counsel for the applicant, learned AGA and perused the record.
Submission of learned counsel for the applicant is that it is beyond the purse of the applicant to comply with the order because of his stringent financial circumstances. The only submission made by the learned counsel for the applicant is that some convenient installments in this regard may be made.
In view of the submissions made by the learned counsel for the applicant this Court does not see any good reason to quash the impugned orders or the proceedings. However, in view of the specific prayer made by the learned counsel for the applicant it is directed that the applicant shall have the liberty to move an application before the court concerned seeking same prayer as has been made before this court in next 10 days. The court below shall look into the same and will pass appropriate orders in this regard as it may deem fit in accordance with law. If the court below feels it appropriate to make some convenient installements in this regard it shall have the right to do so on the strength of the directions issued by this Court in exercise of its inherent jurisdiction in order to meet the ends of justice.
With the aforesaid observation, the application is disposed off.
