JUDGMENT / ORDER

Hon'ble Vedpal,J.
Heard learned counsel for the petitioners and the learned Additional Government Advocate.
Under challenge in the instant writ petition is FIR relating to case crime no. 632 of 2009, under Sections 147, 148, 149, 307, 504 and 506 IPC, police station Sarojani Nagar, district Lucknow.
We have gone through the FIR impugned and the cross FIR relating to case crime no. 632-A of 2009, under Sections 147, 149, 452, 323, 504, 506 and 436 IPC lodged at the same police station annexed as Annexure-2 to the petition.
The incident is admitted to the parties, but how the same has been committed and which of the parties was aggressor is disputed, which is a matter of investigation. Apart from it, the FIR discloses commission of cognizable offence and, as such, the same cannot be quashed.
The writ petition is misconceived and is accordingly dismissed.
However, it is provided that if the petitioners surrender and move application for bail, the same shall be considered and disposed of by the courts below expeditiously.
