The original appellant had approached this Court by way of filing First Appeal No. 501 of 1987 challenging the award passed in Land Acquisition Case No. 3/1983 passed byhte District Court, Godhra on 30.04.1986. Pending the appeal, the original appellant passed away. Thereafter, the appeal was dismissed for want of prosecution on 11.07.2011 as the appellant could not be served.
The present application for joining legal heirs of the deceased appellant has come up on board today. Therefore, in order to avoid any complications, considering the averments made in the application, Civil Application is allowed in terms of para 8 (B) & (C ).
