Considering the facts and circumstances of the case, we are inclined to modify the order of the learned Single Judge dated 07.07.2009 passed in Misc. Civil Application No.958 of 2009 recording undertaking of the bank that they will make good the amount due to the retired employees once the order is passed by the Board of Nominees with interest, with liberty to the Bank to challenge the order of the Board of Nominees if the order is adverse to the Bank. Such an undertaking be filed within a week.
With above observations, the Letters Patent Appeal as well as Civil Application stand disposed of.
