(Per : HONOURABLE MR.JUSTICE V. M. SAHAI) 1. Though this matter is notified for admission hearing, with the consent of learned counsel for the parties, the matter is taken up for final hearing today itself.
2. We have heard Mr. Dipen A. Desai, learned counsel appearing for the petitioner and Mr. P.C. Kavina, learned Senior Counsel assisted by Mr. Biren Vaishnav, learned counsel appearing for the respondents.
3. Learned Senior Counsel Mr. Kavina has informed the Court that some decision has been taken by the Chief Electoral Officer, Gujarat State on 14.10.2012 and in light of that instructions, the claim of the petitioner would be examined and in case the petitioner makes a representation, his grievance will be redressed.
4. In this regard, the petitioner shall make a representation before the respondent No.2 within a period of 2 days from today. In case, such a representation is made, the same shall be decided by the respondent No.2 within a further period of five days in accordance with law by a reasoned speaking order.
5. With the aforesaid directions, this petition stands finally disposed of. Direct service today is permitted.
