For the relief sought through the instant writ petition, the petitioner has already filed a civil suit no. 229 of 2009 before the Civil Court, North Junior Division, Lucknow which is pending alongwith the application for temporary injunction. Considering the urgency of the matter as in front of the gate of the petitioner's house the opposite parties are raising construction, the petitioner has filed the present writ petition before this Court during vacation. The Regular Civil Court is going to open tomorrow.t Therefore, without entertaining the writ petition on merit, we hereby, give liberty to the petitioner to move an appropriate application before the Civil Court tomorrow i.e. 01.07.2010 itself, who shall entertain the same and an appropriate order shall be passed therein which may be ex- parte order.
With the aforesaid observation/direction the writ petition is disposed of finally.
