JUDGMENT / ORDER

The petitioner applied under Exhibit P1 notification for the post of Assistant Professor, wherein the qualification prescribed is BE/B.Tech. and ME/M.Tech in the relevant subject with First Class or equivalent, either in the graduate or post-graduate qualification. The petitioner has a Graduate degree as also a Master's Degree in Engineering, both having been passed in First Class. The petitioner's application was rejected only for the reason that M.Tech. Degree certificate was not enclosed.
2. The learned Standing Counsel for the 2nd respondent appears and submits that it was specifically prescribed in Exhibit P1 that self-attested copies of relevant documents should be attached along with the application. It is also stated that admittedly the petitioner had not submitted M.Tech. Degree certificate, since she had in her representation specifically confessed to the same.
WP(C).No.31522 of 2014 - 2 -
3. However, the mark-list of the M.Tech. Degree was enclosed along with the application. Looking at Exhibit P1 notification, the eligibility, as noticed above, was prescribed. It was also stipulated that self-attested copies of relevant documents in proof of age, qualification and experience ought to be forwarded along with the application. This does not speak specifically of M.Tech. Degree certificate. The mark-list of the M.Tech. Degree course would definitely indicate that the petitioner had qualified M.Tech. Degree examination; that too in First Class, as is indicated in Exhibit P4. In such circumstance, it is only proper that the petitioner be permitted to appear for the written examination scheduled on 30.11.2014. It is so directed.
The writ petition is allowed.
