The instant petition has been filed for a direction upon the court of Civil Judge (Junior Division), Dumariyaganj, Siddharth Nagar to decide application seeking temporary injunction pending in Suit No.311 of 2016 within a stipulated period.
From the order sheet of the suit it appears that on last several dates, the proceedings had to be adjourned because the court was lying vacant.
Under the circumstances, no useful purpose would be served in issuing direction to a court which is lying vacant. The appropriate course for the petitioner is to apply to the District Judge concerned for transfer of the proceeding to any other court of competent jurisdiction so that the matter could be decided.
With the aforesaid observation/liberty, the petition is disposed off.
