Megha vs State

High Court Of Gujarat|14 June, 2012

JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) The Jail remark shows that the appeal is pending and in the application nothing is stated about admission of the appeal.
2. In light of the fact that the appeal is yet not admitted the Court does not have jurisdiction under section 389 of the Code of Criminal Procedure to entertain this application for grant of temporary bail. The application is accordingly rejected. It goes without saying that the Jail authorities shall consider the application of the convict in accordance with law for grant of appropriate relief if the cause is found convincing.
