B.V.Vidyulatha, Advocate) This writ petition is filed under Articles 226 and 227 of the Constitution of India praying to quash the order passed by the respondent in exercise of powers under Section 14B of the Act, dated:15.02.2018 vide Annexure-A and quash the recovery notice dated:20.04.2018 vide Annexure-D by the respondent No.2.
This writ petition, coming on for preliminary hearing in ‘B’ group, this day, the Court made the following:
ORDER This petition has been filed challenging order passed by the Assistant Provident Fund Officer on the ground that the appellate authority was not functioning as on the date of filing this petition.
2. The petitioner has also filed an appeal challenging the impugned order. It is now stated by learned advocates on both sides that appellate authority is functioning.
3. Accordingly, this petition is disposed of reserving liberty to the petitioner to pursue the appellate authority.
