Heard learned counsel for the petitioner, learned Standing Counsel for respondents no.1 & 2 and Sri S.K. Verma, learned counsel for the respondent no.3.
The husband of the petitioner namely Abhishek Sharma is appointed as Assistant Teacher and is working in Prathmik Vidyalaya, Gulabpur, Block Sikandararau, District Hathras.
Under the transfer policy dated 29.03.2018, it is provided that if the husband and wife are in Government service, if possible, they shall be posted in the same district.
The petitioner in the light of said provisions contained in the policy submitted a representation praying for that she may be transferred to the place of posting of her husband.
Learned Standing Counsel submits that no useful purpose would be served in keeping the writ petition pending and appropriate direction may be issued to respondent no.3 to consider the grievance of the petitioner.
Considering the facts and circumstances of the case, without going into the merits of the case and with the consent of the parties, the writ petition is disposed of with direction to the petitioner to file a fresh representation before the respondent no.3/Basic Shiksha Parishad, Prayagraj raising all her grievances within a period of two weeks from today. In case any such representation is filed by the petitioner, the respondent no.3 shall consider and decide the same by reasoned and speaking order within a period of three months thereafter.
With the aforesaid observations, the writ petition is disposed off.
