ORDER:
This writ petition is filed for a Mandamus to set aside proceedings in Rc.No.4502/2014-B dated 10.09.2014 of respondent No.2.
A perusal of the impugned order shows that the petitioner’s fair price shop authorization has been suspended on the allegation that there is a shortage of 1.23 quintals of rice compared to the book balance. Respondent No.2 has also made other allegations, which do not appear to be too serious to warrant suspension. However, since the petitioner has a remedy of appeal against the order impugned in this writ petition, I am not inclined to entertain the same.
The writ petition is accordingly dismissed, without adjudicating on the merits of the case, with liberty to the petitioner to avail the remedy of appeal.
As a sequel to the dismissal of the writ petition, W.P.M.P.No.38812 of 2014 shall stand disposed of as infructuous.
