REDDY KOVVURI COUNSEL FOR THE RESPONDENT: THE PUBLIC PROSECUTOR Petition under Sections 437 439 of Cr.P.C., praying that in the circumstances stated in the memorandum of grounds filed herein, the High Court may be pleased to enlarge the petitioners on regular bail in Cr.No.12 of 2014 on file of the Mydukur (U/G) Police Station, Mydukur, Y.S.R.District The Court made the following Order:
“The petitioners are A1 to A3. They seek for grant of bail. They allegedly committed offences under Section 307, 353 and 379 IPC, Section 34 IPC, Section 3 of PDPP Act and Section 29 of the Andhra Pradesh Forest Act. It is alleged that the petitioners were transporting red sandal wood and that they attempted to dash the forest officials with the Scorpio van. In view of the nature of the offences involved against the petitioners and also in view of the fact that the first petitioner is a student, the second petitioner is a driver and the third petitioner is a watchman in Forest Protection, I consider it appropriate to enlarge the petitioners on bail. However, in view of the nature of the offence alleged against them, they deserve to be enlarged on bail on terms only.
Accordingly, this petition is allowed. The petitioners are enlarged on bail on a bond of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties each in a like sum to the satisfaction of the Judicial Magistrate of First Class, Mydukur, Y.S.R.District. After their release, they shall appear on every day between 9.00 a.m. and 6.00 p.m. before the Station House Officer, Mydukur U/G Police Station.”
