Heard counsel for the petitioner, learned standing counsel for the State respondents and Sri Avneesh Tripathi for respondents no.3 and 4.
The instant writ petition has been filed seeking a mandamus commanding the respondents to treat the petitioner institution as a minority institution while recommending students for admission to B.Ed. course in the petitioner institution.
The specific case of the petitioner is that it was accorded minority status by National Commission for Minority Educational Institutions, New Delhi by issuing a certificate dated 20.2.2014. A copy of the said certificate has been brought on record as Annexure-3 to the writ petition. It is pointed out that the affiliating University i.e. Chaudhary Charan Singh University, Meerut by communication dated 28.10.2017 requested the State Government to apprise it of its stand in regard to the alleged claim of the petitioner institution, so that consequential action is taken accordingly. However, so far the State Government has not passed any order and the petitioner institution apprehends that the recommendation of the students for admission to B.Ed. would be made by the concerned University ignoring minority character of the petitioner institution. He, therefore, submitted that the first respondent be directed to take decision in the matter within a specified time.
Learned standing counsel very fairly states that in case no decision has been taken in the matter, the first respondent will take decision within four weeks.
Having regard to the stand taken before this Court by learned standing counsel as well as the submissions made by learned counsel for the petitioner, the instant writ petition is disposed of by directing the first respondent to pass a speaking order on the claim of the petitioner with regard to its minority character within a period of four weeks from the date of production of a certified copy of this order alongwith a fresh representation.
